Special taxation terms & incentives
• Free trade zones in Iquique and Punta Arenas: exemption from corporate income tax (first category tax), VAT, and customs duties on zone operations.\n• Pro-Pyme SME regime: reduced 25% first category tax rate versus the general 27%.\n• R&D tax credit (through 2035): credit against first category tax of 35% of qualifying R&D expenses, with the remainder deductible.\n• Tax benefits for companies operating in the northern and southern extreme zones.\n• Exports are zero-rated for VAT, with VAT recovery on imported goods used in export activities.
Crypto & digital assets
AllowedTrading and ownership of cryptocurrencies are legal. The CMF Fintech Law (2023) regulates virtual asset service providers. Crypto profits are taxed as ordinary income; corporate gains taxed at standard 27% rate. Banks remain cautious with crypto-related businesses. Stablecoins can be used as payment method in B2B transactions. No specific tax exemptions for crypto.
Banking
Available at major Chilean banks: Banco de Chile, Santander, BCI, Itaú. Requires company RUT, legal representative with Chilean domicile, KYC documentation, and business plan. Approval typically takes 2–4 weeks after company is registered. Bank decisions are at their discretion; proper documentation and positioning significantly improve approval chances.
Personal bank accounts require Chilean residence permit (RUT for residents), proof of address, and source of funds. Non-residents generally cannot open personal accounts directly. Available through major banks once residence status is obtained.
Legal & compliance
Local legal representative (domiciled in Chile) is mandatory; physical office and staff recommended for active business operations and bank application. Companies under the simplified Pro-PYME regime (corporate tax 23%) face lower compliance burden than companies under the general regime (corporate tax 27%).
35+ tax treaties (US, UK, Spain, China, Brazil, most EU countries). Chile has an extensive DTT network, but in practice many foreign investors do not benefit from treaties because their country of citizenship does not have an agreement with Chile.
Ownership structure
100% foreign ownership allowed for all major corporate forms (SpA, Ltda, S.A.) in virtually all sectors. No local partner or director required as shareholder, but a local legal representative with Chilean domicile is mandatory. Restrictions apply only to a few sensitive sectors (border-area real estate, certain media licenses). No minimum capital required.
